These terms are the agreement between you and the operator of Koemi ("we", "us") for the website at koemi.ai, the hosted service behind it, and the Koemi desktop app. Who the operator is, and why the full identity is not printed here during the beta, is in the legal notice. By creating an account or using Koemi, you accept these terms. If you do not accept them, do not use Koemi.

1. What Koemi is, and what it is not

Koemi is a voice-first AI companion. Dara, the character you talk to, is software: her replies and her voice are generated by machine learning models, and her face is an animated character. She is not a person, and she does not have feelings, opinions, or knowledge of her own.

She is made for company and conversation. She is not a source of professional advice. Nothing she says is medical, psychological, legal, or financial advice, and she is not a substitute for therapy or for talking to a qualified professional. AI models also make mistakes: treat anything factual she says as unverified.

If you are in crisis, Koemi is the wrong tool. If you are in danger or thinking about harming yourself, contact your local emergency number (112 anywhere in the EU) or a crisis line in your country.

2. The beta

Koemi is in heavy beta, and anyone can create an account. The beta has real consequences, and accepting these terms means accepting them:

  • The service is free during the beta. There is no paid plan today.
  • Things will break. Features may change, disappear, or be reset without notice.
  • Availability is not promised. The service, or the model behind Dara, may be offline at any time, and the beta itself may be paused or ended.
  • Usage is capped: each account has a monthly usage allowance, and the service answers with a limit notice once it is spent.

3. Who may use Koemi

You must be at least 15 years old to use Koemi. It is not made for children, and you may not use it on behalf of someone under that age. We reserve the right to ask you for proof of age at any time and to close accounts that do not meet the requirement.

4. Your account

  • Your account is personal. Do not share your password or lend your seat to someone else.
  • Give us a working email address. It is how important notices about the service or these terms reach you, and today it is the only way to recover an account whose password is lost.
  • You are responsible for what happens under your account. Tell us if you think it has been compromised.

5. Fair use

Using Koemi, you agree not to:

  • break the law, or use the service to harm, harass, or defraud anyone;
  • probe, attack, overload, or attempt to gain unauthorized access to the service or to other people's accounts or data;
  • scrape the service, automate access to it, or resell access to it;
  • circumvent usage caps or technical protections.

We can suspend or close accounts that break these rules, with notice where that is reasonable.

6. What you say, and her memory

  • What you say to Dara is processed to produce her reply and is not stored on our servers. There is no server-side transcript. The details live in the Privacy Policy.
  • She keeps no record of past sessions: the conversation lives in the app's memory while you talk and ends when you quit. There is nothing for us to restore, because it never exists as a stored record.
  • You keep whatever rights you hold in what you say to her. You give us only what is needed to run the service: the technical right to process your words and voice, in transit, to generate her answer.
  • Her replies are generated for you. Use them freely for personal purposes. We do not claim ownership of them.

7. The desktop app

We grant you a personal, non-exclusive, non-transferable licence to install and run the Koemi desktop app for your own use. You may not modify, decompile, or reverse engineer it, except to the extent the law expressly allows this regardless of contract terms. The app includes third-party components under their own licences, listed in the third-party notices.

8. Availability and warranty

During the beta, Koemi is provided as is and as available, without any warranty of availability, accuracy, or fitness for a particular purpose, to the maximum extent the law permits. If you use Koemi as a consumer, nothing in these terms takes away rights that the law of your country of residence grants you and that cannot be waived by contract.

9. Liability

To the extent permitted by law, we are not liable for indirect damages or for losses caused by the beta nature of the service, such as unavailability, data resets announced above, or model mistakes. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for intentional misconduct, gross negligence, or personal injury.

10. Ending things

  • You can stop at any time. Ask us to delete your account (see the Privacy Policy for what deletion does).
  • We can suspend or close your account if you break these terms, if the law requires it, or if the beta ends. Where reasonable, we will give you notice first.

11. Paid plans

There are none today, and nothing in these terms creates one. If Koemi introduces subscriptions, they will come with their own clear terms presented before you pay: pricing with taxes included, renewal and cancellation rules, and the withdrawal rights EU consumer law grants you. You will never be moved to a paid plan silently.

12. Changes to these terms

We may update these terms as the product and the law evolve. For material changes we will notify you (by email or in the app) reasonably in advance, and using Koemi after the change takes effect means you accept it. If you do not, stop using the service and ask us to delete your account.

13. Law and disputes

These terms are governed by French law. If you use Koemi as a consumer in the EU, you also keep the protection of the mandatory rules of the country you live in, and you may bring disputes before the courts of that country. Once paid plans exist, an approved consumer mediation body will be named here.
